Landlords may argue that the tenant caused or contributed to the problem. This can happen in claims involving damp, mould, damage, blocked drains, poor ventilation or access for repairs.

That does not automatically mean you cannot claim.

The issue will depend on the evidence. Photographs, repair records, inspection reports, complaint histories, medical evidence and expert evidence may all help show what caused the problem and whether the landlord acted reasonably.

Havard Law Solicitors can review the position and advise whether the landlord’s argument can be challenged.
